General Conditions
of the PerfectDraft Loyalty Program

1. Partners of the PerfectDraft Loyalty Program

1.1. PerfectDraft Europe S.A.S. (hereafter referred to as "PerfectDraft"), a simplified joint-stock company with a capital of 23,940 EUROS, headquartered at 5001 Rue du Chemin Vert 59273, Fretin, France, registered with the RCS of Lille under number 497 634 030 (Siret 497 634 030 00074 - VAT FR31497634030 - APE 4791B), has established a loyalty program called the "Loyalty Program".

1.2. These general conditions of the Loyalty Program apply to sales made on the French website of PerfectDraft. Other European sites of PerfectDraft Europe each have distinct and specific conditions for each country.

2. Eligibility

2.1. The loyalty program is open to all individuals and consumers aged at least 18 years. By joining the loyalty program, the customer confirms being at least 18 years old. The customer is not required to have an address in France to join the loyalty program. However, some rewards require a delivery address in metropolitan France (excluding Corsica and Overseas Departments and Territories).

2.2. When placing their first order, the customer must accept PerfectDraft's general conditions. If the customer does not accept them, they cannot place orders or benefit from the loyalty program's advantages. It is the customer's responsibility to understand the loyalty program's general conditions. If the customer does not understand them, they must contact customer service.

2.3. The customer is required to enter personal information such as delivery address, billing address, and email address to place an order and join the loyalty program. Some rewards require additional personal information (such as the complete birth date including day, month, and year) to be received. If the customer does not wish to provide this additional personal information, they will not be able to receive and use the reward. Additional personal information can be modified at any time in the customer's account.

2.4. The customer can only have one account per email address. It is not possible to merge two existing accounts into one. If the customer has created multiple accounts with different email addresses, they must choose the appropriate account to place orders. They cannot use multiple accounts to attempt to benefit multiple times from loyalty benefits, which would be considered fraud. The customer agrees to request only one membership to the loyalty program worldwide.

3. Membership

3.1. The customer joins the loyalty program simply by creating an account in PerfectDraft's online store. Customers who already have an account are automatically part of the loyalty program. There are no fees to join the program.

3.2. To join the loyalty program, the customer is not required to place orders. Simply having an account is sufficient to join.

3.3. The customer is not required to pay to join the loyalty program. If the customer has already paid for the subscription to the old loyalty program between 15/07/2020 and 15/09/2020, they must contact customer service before 15 November 2020 to request a refund. The refund will be credited to the customer's fund.

4. Rewards

4.1. Depending on their status, the customer can receive up to six rewards in total. Rewards are available in the customer's account, except for discounts and exclusive offers available in the "my account", "discount vouchers" section. Rewards are sent by email if the customer subscribes to the newsletter.

4.2. Points: each customer receives points in accordance with article 5 herein.

4.3. Birthday gift: each customer receives a €5 discount coupon on their birthday. The customer will find a coupon in their account which can be added to their order. The coupon is valid for seven (7) days before the customer's birthday and expires seven (7) days after. Its validity period is therefore fifteen (15) days in total. The coupon can be used if the total value of the order is at least €50 excluding shipping costs. The customer must enter their complete birth date (day, month, year) in their account to receive the coupon, and this at least ten (10) days before the birthday. The coupon will not be sent if the birth date is not known or incomplete.

4.4. Exclusive offers: customers with "Silver" or "Gold" status will receive exclusive offers by email if they subscribe to the newsletter. The offers will be defined by PerfectDraft.

4.5. Processing of your keg returns within 24 hours for "Silver" and "Gold" customers: Affected customers print their express return label from their customer account, and the customer receives a code by SMS to confirm their agreement. 24 hours after the package is dropped off at the collection point, the customer receives the deposit amount in their fund. Collected deposits will be credited at best at the time of keg collection and at the latest at the end of our delivery round.

4.6. Free delivery on the fourth order: customers with "Silver" or "Gold" status receive, after the third order, a free delivery coupon (in their account or by email if they subscribe to the newsletter) to use after the third order placed in the previous 365 days. The coupon must be added during payment and is valid only for a delivery by Mondial Relay or by the "by Saveur Bière" delivery service and starting from €60. The coupon is valid for 90 days from the date of the third order. The free delivery coupon is not valid for the following products: the monthly subscription box, the PerfectDraft machine, and the Beery Christmas. The coupon does not apply to deliveries in Corsica or in the Overseas Departments and Territories.

4.9. Rewards cannot be exchanged for any other value or item. Furthermore, they cannot be transferred or sold to another customer or account. Loyalty program reward coupons received by the customer can only be used once per customer.

4.10. If the customer has used one of the loyalty program rewards and cancels or returns the order, the rewards will not be refunded.

4.11. Loyalty program rewards cannot be accumulated.

5. Points

5.1. The customer will receive 1 point for every euro spent on the purchase of PerfectDraft kegs (not applicable for the purchase of a machine and keg pack) on PerfectDraft, excluding credits, payments by Saveur Bière gift card, excluding deposit and shipping costs. Points are immediately displayed in the customer's account when placing an order. Each time a customer reaches 150 points, they automatically receive €3 in their fund. Thus, each point has a value of approximately €0.02.

5.2. Only PerfectDraft kegs that can be purchased on PerfectDraft are included in the loyalty program and count towards the calculation of acquired points, excluding all other products such as bottles, cans, assortments, glasses, machine and keg packs, keg and glass packs, etc. In addition, shipping costs, payments by PerfectDraft gift card, credits, and keg deposits are not taken into account to determine the total number of points acquired for an order.

5.3. A customer's points expire if they have not placed any orders in the 365 days following the last order. Therefore, the customer must place at least one order per year to maintain the total value of the points. Once the points' value is converted into an amount of €3 in the fund, they cannot expire. The customer can use the money in their fund at any time.

5.4. When the customer decides to cancel or return an order, the points earned from that order will be deducted from their total points.

5.5. If not all products could be delivered as indicated in the order confirmation, the customer can contact customer service and report the issue to find a solution.

5.6. It is not possible to transfer points from one account to another. The customer cannot sell points to another customer and is not authorized to do so.

5.7. All information related to points (earnings, expenditures, expiration) is found in the customer's account.

5.8. It is not possible to transfer the fund's value to the customer's bank account, including coupons collected through points or credits.

6. Status

6.1. Each PerfectDraft customer is assigned a status. There are three statuses: "Bronze", "Silver", and "Gold". The status is determined based on the total number of orders placed from today minus 365 days (a rolling year). "Bronze" customers place 0 to 2 orders per year, "Silver" customers 3 to 4 orders per year, and "Gold" customers 5 orders or more per year.

6.2. A customer's status is based on their purchase behavior on PerfectDraft during the current year. If the customer meets the required conditions to move up to the next level, their status will become "Silver" (if they were "Bronze") or "Gold" (if they were "Silver").

6.3. The customer is informed of their status in their account. The customer's status is automatically updated in the system with the possibility of moving up to the next level immediately after placing an order or the possibility of moving down due to not being an active member. An active member must have placed at least one (1) order on the Site in the last 365 days.

7. Data Processing and Confidentiality

7.1. PerfectDraft uses the customer's personal information provided when creating an account, placing orders, and receiving or exchanging rewards to analyze the functionality of the loyalty program, customer service, and for personal offers.

7.2. Personal data received within the framework of the loyalty program will be used in accordance with applicable data protection legislation and PerfectDraft's privacy policy available here. By participating in the loyalty program, the customer consents to PerfectDraft processing their personal data for the purposes of implementing the loyalty program.

7.3. By providing their contact details and subscribing to the newsletter, the customer receives information about rewards as well as marketing campaigns. If the customer no longer wishes to receive this information, they can unsubscribe from the newsletter at any time.

8. Data Modification and Termination

8.1. The customer is authorized to modify their email address, delivery address, and billing address without losing their status, rewards, or points.

8.2. The customer can terminate membership in the loyalty program at any time by deleting their account. Rewards and points are no longer accessible after account deletion, nor refundable to a payment method.

9. Loyalty Program Changes.

9.1. We reserve the right to add and/or modify the loyalty program at any time, at our sole discretion. This may include, in particular, changing the number of loyalty points earned for various actions and activities, or modifying the activities and actions eligible for loyalty points. Additionally, we may also change the number of loyalty points required to redeem cash from the pool. We may also modify the value of each loyalty point.

9.2. Any change or modification made to the loyalty program will take effect immediately after the publication of the new version of the terms and conditions on the Site.

9.3. We reserve the right to terminate the loyalty program with a 3-month notice period. Your right to earn loyalty points and use your pool will end three months after we notify you of the termination of the loyalty program.

10. Breach of Terms.

10.1. We may terminate your account and revoke all or part of your loyalty points and your pool if you violate these conditions. We reserve the right to freeze or terminate the loyalty program account of any individual in case of fraud or abuse related to this loyalty program. In such a case, all accumulated points will be forfeited. PerfectDraft Europe reserves the right to modify, delete, or change the number of points and the amount in the pool available on your account that may have been credited by mistake, whether due to human error or computer error.
